Motion for Sanction against J. Mark Brewer and Brewer & Pritchard Law due to bad faith Bankruptcy Claims and alleged Fraud on the Court!
Ohh naughty naughty! see my mum always said ‘Be fair, Be honest, Be true or God will get you!’ and looks like she might have been right. Tis indeed true as she says that God doesn’t need money to pay his debts, but it looks rather like J. Mark Brewer and his law firm will.
Indeed even Mr Philip W. Brewer may well need some funding as he is in turn being considered as one who may well need calling to account according to Randy Williams and his Motion for Sanctions!
Now the text of the Motion to Sanction is well worth reading so quickly go here:
http://spckssg.wordpress.com/2008/09/10/motion-for-sanctions/
So whats so good, well like I said the fact that it exists says that wrongdoers will be called to account – indeed Mr Williams sites this as being very important: ‘and he(J. Mark Brewer) and his firm must bear responsibility for these actions and make amends to this Court, the Trustee and most significantly the bankruptcy process so that creditors, especially those in a situation like this who are looking at the system from outside U.S. borders, can see that parties who would attempt to subvert the law to escape their responsibilities will be punished.’(Point 14).
The UK Courts and the Workers rights are being held as important and not something to be cheated and worked around! (point 10 in the motion).
ENC is shown to be a dubious cover at best! indeed Mr Randy Williams states ‘Mr. Brewer and his firm engaged in a concerted scheme to mislead this Court and to file a bad faith bankruptcy case. Mr. Brewer’s action in failing to disclose the true name of the Debtor and the cancellation of its contract and assignment of those rights to another closely held company of Mr. Brewer is a fraud on this Court.’ (point 8 of the Motion).
The Closely held company is ENC, but lets not forget that there is also Durham Cathedral & Chichester Shop Managment Co’s and they are all run by the same people! ooh – blurry lines there then!! and it would seem not ones that are likely to be able to do what they were perhaps intended to do: ‘to gain a stay against the claims of creditors against himself individually, ENC and St. Stephen the Great Registered Charity.’ (point 10 of the Motion). I draw your attention, all those with potential claims, to the word INDIVIDUALLY, however I would also draw your attention to the fact that Mr Williams has made his Motion for Sanction against not only Mr J. Mark Brewer Individually but also against his Law firm – now given it is my understanding that both staff and suppliers had to deal directly with employed members of Mr J. Mark Brewers Law Firm in dealing with their Pay, Reporting/Contact and Accounts Issues – well I know what inference I might take from that if it was I in such a situation. After all precedence is what the law is built on!!
Dave Walker gets a mention, indeed his back-up site and an article contained therein is used as a reference tool (point 4 of the motion) – vindication and proof perhaps that the C&D was wrongful and that the actual reportage of Mr Walker, Phil Groom, Unicorn Tree Books, Elizaphanian, Christian Marketplace and any others that may have recieved or been included in such C&D’s as were sent by Mr J. Mark Brewer were fair comment and honest reportage! One supposes that may leave Mr J. Mark Brewer and his Law Firm with a few apologies and letters of retraction to send out or of course on supposes that they themselves might be considered to have been in the wrong and culpable to some degree by their actions and threats.
So all in all that’s a pretty solid slap and not one that’s not going to leave some sort of mark or sting. Still spare the rod and spoil the child!
Anyway liking youtube as I do I leave you here a few things I found and again they seem particularly apt!
Given they switched on the Large Hadron Collider today – I thought this one might work pretty well for not only that, but also for this situation as well!
And last, but by no means least – for after all many that will be first must be the last! (matthew 19:30),- as I started with my dear old mum I am ending with her favourite singer and a song that is for all those that are and have been in the midst of the troubles but were willing to take the mountain and practise their tying up skills! Hope you enjoy!
Ok as usual for more reportage go see spckssg, Matt Wardman and the others over in the links sections.
Brewer & Pritchard Lawyer J. Mark Brewer has his SSG LLC Chapter 7 Bankruptcy case tossed out “with Prejudice”!
So the ruling came in on the St Stephen the Great Chapter 7 Bankruptcy case in relation to the Motion to Dismiss due to amongst other things supposed irregularities in the filings – like the named company doesn’t exist, like despite owning a chain of bookshops in the UK no assets as such were listed, like well ok I could go on for a while best you read it yourself if you need refreshing – http://www.ministryoftruth.me.uk/?s=ssg
So anyway the Judge did his job and tossed the Chapter 7 application out “with prejudice”. Now the full transcript from the court isn’t out yet, which is kind of a pity as it would be nice to know exactly what was said. However it has got to be a bit of a kicker for Mr J. Mark Brewer, after all he was working as his own lawyer and therefore a representative of his Law firm Brewer & Pritchard, PC of Houston (www.bplaw.com)- and getting a case thrown out never particularly good for a lawyer or law firms reputation, but getting in the sort of taffle this one has certainly can’t be that good one supposes. Still there we go win some lose some!
I guess though that this means Mr J Mark Brewer of Brewer & Pritchard, PC operating out of Houston, Texas is now going to have to go the more expensive route and do it the right way as he should of anyway! and go through the UK courts and Bankruptcy procedures! (http://www.thebookseller.com/news/65905-brewer-defends-ssg-liquidation.html) But wait Mr J Mark Brewer is going through the UK Courts already – he’s due (or someone representing him is) to attend a case conference on the 18th September in Bury St-Edmunds in relation to the Employment Tribunal(s) of about 30 very unhappy workers! or at least thats what I was told by one of the USDAW people. Oh and in case he was thinking that taffling people with lots of different names for the same organisational structure doing the same job was going to work the ET has drawn together all the cases for SSG & ENC & St Stephen the Great Charitable Trust.
So it looks like things could get interesting! but whats this? as if that’s not enough the brother Phil (that’s Philip W. Brewer of Tucson,Arizona just in case you mistakenly though Tucson was in England – after all Mr Philip W. Brewer certainly seems to: http://asingleblog.wordpress.com/2008/08/10/about-that-beast-of-a-plane/ )! would seem to be getting in on the act of not working entirely in a manner one might expect with such high cost legal advice at hand to always check the ramifications of statements made & written! It would seem some people just are not too clear on the concepts of contractual obligation and complying with regulations it would seem from what is said here: http://spckssg.wordpress.com/2008/08/24/philip-brewer-says-immediately-post-this/
I think Phil must be fed up with all the attention his brother is getting and all the other people out there who have people setting up facebook pages for them, and all the friends they have, so maybe people should be a little generous and go friend him! http://www.facebook.com/srch.php?nm=philip+w+brewer
I am sure the D&C at Durham Cathedral would love to consider him a friend and visit some with him: especially in light of the petition going on: http://spckssg.wordpress.com/2008/09/01/durham-cathedral-bookshop-petition-update/
So anyway there we go the fun that is the goings on of SSG (Saint Stephen the Great) and its many incarnations though not SSG LLC as they don’t exist, the Texas Bankruptcy Courts would seem to say so!http://www.mattwardman.com/blog/2008/08/29/mark-brewer-ssg-bankruptcy-application-dismissed-with-prejudice-in-houston-texas/
To really keep up to date with everything going on then visit some of the links across the way, Matt Wardman & SPCKSSG are perhaps the most detailed, with ministry of truth for a more legal assessment.
Oh by the way I thought maybe this might hve been something Mr Brewer should have looked at a few months back – but then hindsight and all that lark!
