J. Mark Brewer Lawsuit in Stanford Scandal, Brewer & Pritchard P.C. (Submitted by Sondra Jurica, Attorney at Law to the District Court for the Southern District of Texas Houston Division) - Talk about a scandal of Massive Proportions!
Hypocrites, lawsuits, bankruptcy, scandal, wrongdoings and understandings of alleged Frauds upon Courts and people - or as my mum likes to say, God needs no money to pay his debts!

Ohh dear Mr J Mark Brewer – you know the one, the lawyer from out of Houston and one of the founding Partners in Brewer & Pritchard P.C. amongst other things, seems to be a bit upset that he can’t get to his funds that have been caught up in the Stanford Scandal! It’s just not cricket don’t you know, depriving people of their legal rights, properties and money!!

It seems he is a bit confused by why the assets have been seized and frozen – there were rather a lot of people that felt that way of course when Mr J Mark Brewer perpertrated his alleged Fraud upon the Court by willfully and wrongfully claiming bankruptcy of an organisation that wasn’t actaully under any sort of US Jurisdiction – oh and add to that there are a fair number of ex-Employee’s and Publishers in the UK that would seem to be wondering why they weren’t given the rights he seems to be seeming to say that he should have had the right to with his frozen money and situation in regards to Pershing LLC and Stanford Holdings!
I can understand the confusion Ponzi Scheme’s, Pheonix Companies, Corporate Fraud – well it is all really rather nefarious and hard for the mind to grasp what’s so wrong with these things if you don’t really understand what the problem really is, why it’s wrong and who it really hurts and I guess someone with such a loose concern for ethics and the possibilities of fraud would be a bit confused by the situation and feel rather hard done by.
Some of the rest of us would rather seem to think it a type of rough justice! after all those that live by the sword die by the sword as the saying goes – though I think sword sounds rather like another f-word that may be more apropros in this situation!

By the way those of us who feel like this in regards to Mr J Mark Brewer and co. do, I am quite sure, feel real concern and sympathy for those genuinely innocent of any type of wrongdoing ever and who are effected by the situation of having their resources suddenly put in turmoil and not knowing what’s going on and why – see we emote with them as we understand how they must feel due to the situation Mr J. Mark Brewer put his staff and those he owed and owes money to and the continuing tribulation they all feel – especially the ex-employee’s as they continue in their employment tribunals and lawsuits against Mr J. Mark Brewer, his wife and other family members registered as directors in the various agencies they are using in the UK – St Stephen the Great Charitable Trust, SSG LTD, ENC, Durham Cathedral Shop Managment Co, Chichester Shop Managment Co, Third Space Books and any others I am as yet unaware of! – for more on this situation just follow some of the links on the Right hand side!!)

I refer people to some of the previous blogs below this one, a few have some interesting definitions of words in them – I particularly like the definition of Hypocrite as it often fits many situations and many people and it seems to be rather redolent here.

Ohh naughty naughty! see my mum always said ‘Be fair, Be honest, Be true or God will get you!’ and looks like she might have been right. Tis indeed true as she says that God doesn’t need money to pay his debts, but it looks rather like J. Mark Brewer and his law firm will.

Indeed even Mr Philip W. Brewer may well need some funding as he is in turn being considered as one who may well need calling to account according to Randy Williams and his Motion for Sanctions!

Now the text of the Motion to Sanction is well worth reading so quickly go here:

http://spckssg.wordpress.com/2008/09/10/motion-for-sanctions/

So whats so good, well like I said the fact that it exists says that wrongdoers will be called to account – indeed Mr Williams sites this as being very important: ‘and he(J. Mark Brewer) and his firm must bear responsibility for these actions and make amends to this Court, the Trustee and most significantly the bankruptcy process so that creditors, especially those in a situation like this who are looking at the system from outside U.S. borders, can see that parties who would attempt to subvert the law to escape their responsibilities will be punished.’(Point 14).

The UK Courts and the Workers rights are being held as important and not something to be cheated and worked around! (point 10 in the motion).

ENC is shown to be a dubious cover at best! indeed Mr Randy Williams states ‘Mr. Brewer and his firm engaged in a concerted scheme to mislead this Court and to file a bad faith bankruptcy case. Mr. Brewer’s action in failing to disclose the true name of the Debtor and the cancellation of its contract and assignment of those rights to another closely held company of Mr. Brewer is a fraud on this Court.’ (point 8 of the Motion).

The Closely held company is ENC, but lets not forget that there is also Durham Cathedral & Chichester Shop Managment Co’s and they are all run by the same people! ooh – blurry lines there then!! and it would seem not ones that are likely to be able to do what they were perhaps intended to do: ‘to gain a stay against the claims of creditors against himself individually, ENC and St. Stephen the Great Registered Charity.’ (point 10 of the Motion). I draw your attention, all those with potential claims, to the word INDIVIDUALLY, however I would also draw your attention to the fact that Mr Williams has made his Motion for Sanction against not only Mr J. Mark Brewer Individually but also against his Law firm – now given it is my understanding that both staff and suppliers had to deal directly with employed members of Mr J. Mark Brewers Law Firm in dealing with their Pay, Reporting/Contact and Accounts Issues – well I know what inference I might take from that if it was I in such a situation. After all precedence is what the law is built on!!

Dave Walker gets a mention, indeed his back-up site and an article contained therein is used as a reference tool (point 4 of the motion) – vindication and proof perhaps that the C&D was wrongful and that the actual reportage of Mr Walker, Phil Groom, Unicorn Tree Books, Elizaphanian, Christian Marketplace and any others that may have recieved or been included in such C&D’s as were sent by Mr J. Mark Brewer were fair comment and honest reportage! One supposes that may leave Mr J. Mark Brewer and his Law Firm with a few apologies and letters of retraction to send out or of course on supposes that they themselves might be considered to have been in the wrong and culpable to some degree by their actions and threats.

So all in all that’s a pretty solid slap and not one that’s not going to leave some sort of mark or sting. Still spare the rod and spoil the child!

Anyway liking youtube as I do I leave you here a few things I found and again they seem particularly apt!

Given they switched on the Large Hadron Collider today – I thought this one might work pretty well for not only that, but also for this situation as well!

And last, but by no means least – for after all many that will be first must be the last! (matthew 19:30),- as I started with my dear old mum I am ending with her favourite singer and a song that is for all those that are and have been in the midst of the troubles but were willing to take the mountain and practise their tying up skills! Hope you enjoy!

So the ruling came in on the St Stephen the Great Chapter 7 Bankruptcy case in relation to the Motion to Dismiss due to amongst other things supposed irregularities in the filings – like the named company doesn’t exist, like despite owning a chain of bookshops in the UK no assets as such were listed, like well ok I could go on for a while best you read it yourself if you need refreshing – http://www.ministryoftruth.me.uk/?s=ssg

So anyway the Judge did his job and tossed the Chapter 7 application out “with prejudice”. Now the full transcript from the court isn’t out yet, which is kind of a pity as it would be nice to know exactly what was said. However it has got to be a bit of a kicker for Mr J. Mark Brewer, after all he was working as his own lawyer and therefore a representative of his Law firm Brewer & Pritchard, PC of Houston (www.bplaw.com)- and getting a case thrown out never particularly good for a lawyer or law firms reputation, but getting in the sort of taffle this one has certainly can’t be that good one supposes. Still there we go win some lose some!

I guess though that this means Mr J Mark Brewer of Brewer & Pritchard, PC operating out of Houston, Texas is now going to have to go the more expensive route and do it the right way as he should of anyway! and go through the UK courts and Bankruptcy procedures! (http://www.thebookseller.com/news/65905-brewer-defends-ssg-liquidation.html) But wait Mr J Mark Brewer is going through the UK Courts already – he’s due (or someone representing him is) to attend a case conference on the 18th September in Bury St-Edmunds in relation to the Employment Tribunal(s) of about 30 very unhappy workers! or at least thats what I was told by one of the USDAW people. Oh and in case he was thinking that taffling people with lots of different names for the same organisational structure doing the same job was going to work the ET has drawn together all the cases for SSG & ENC & St Stephen the Great Charitable Trust.

So it looks like things could get interesting! but whats this? as if that’s not enough the brother Phil (that’s Philip W. Brewer of Tucson,Arizona just in case you mistakenly though Tucson was in England – after all Mr Philip W. Brewer certainly seems to: http://asingleblog.wordpress.com/2008/08/10/about-that-beast-of-a-plane/ )! would seem to be getting in on the act of not working entirely in a manner one might expect with such high cost legal advice at hand to always check the ramifications of statements made & written! It would seem some people just are not too clear on the concepts of contractual obligation and complying with regulations it would seem from what is said here: http://spckssg.wordpress.com/2008/08/24/philip-brewer-says-immediately-post-this/

I think Phil must be fed up with all the attention his brother is getting and all the other people out there who have people setting up facebook pages for them, and all the friends they have, so maybe people should be a little generous and go friend him! http://www.facebook.com/srch.php?nm=philip+w+brewer

I am sure the D&C at Durham Cathedral would love to consider him a friend and visit some with him: especially in light of the petition going on: http://spckssg.wordpress.com/2008/09/01/durham-cathedral-bookshop-petition-update/

So anyway there we go the fun that is the goings on of SSG (Saint Stephen the Great) and its many incarnations though not SSG LLC as they don’t exist, the Texas Bankruptcy Courts would seem to say so!http://www.mattwardman.com/blog/2008/08/29/mark-brewer-ssg-bankruptcy-application-dismissed-with-prejudice-in-houston-texas/

To really keep up to date with everything going on then visit some of the links across the way, Matt Wardman & SPCKSSG are perhaps the most detailed, with ministry of truth for a more legal assessment.

Oh by the way I thought maybe this might hve been something Mr Brewer should have looked at a few months back – but then hindsight and all that lark!

Given that there is now an official petition going in regards to Durham Cathedral Shop, I thought this little You Tube item was perhaps of passing interest, especially as I think (though of course that would mean I am, and its entirely possible I am not!) J. Mark Brewer made a stand in his 2000 Congressional electioneering on the issue of Taxes and the IRS etc

I also found this one to be quite fun as well! Just change some names and organisations and well you get the idea!

So anyway all the fun aside take a trip over to the petition, which already has well over 100 signatures gathered in about 24 hours and see how you feel about joining with the others and petitioning the goverment of Durham Cathedral.
Just the click the link to read the petition: http://www.ipetitions.com/petition/durhamcathedralbookshop/index.htm

So over at BenGallagher.com, Ben posted an interesting article on who the registered owner of the St Stephen the Greatofficial website domain - ststephentrust.org.uk – was registered to and was trading as. Actually its an interesting and funny article - I found it quite amusing how he puts forward an amusing and hypothetical view of Mark Brewer, that Lawyer from Houston who is a Very Private Man, summoning up 40 dead martyr guys and having a meeting at which they agree to registering the domain name. It really is an amusing article.

However given all that I thought that I would bring this to you all as it’s entirely possible that this is the more accurate lot who have registered the site and own the domain!

http://40martyrs.org/joomla/index.php

This is a nice new and large church (or so it looks from the pics and plans) based out in Sugar Land, Texas – ain’t that sweet! – Sugar Land by the way is a Suburb of Houston for those who aren’t US situated.

So the question, given they are listed as the registrant and it therefore would seem to say that St Stephen the Great is part of their trading endeavours, is how are they connected to the UK regsitered charity, and how come their regsitered address is that of Mr Mark Brewer’s houston Law offices, Brewer & Pritchard – BP Law? and not their own Sugar Land address?

Is this yet another charity registered through these offices, rather like the Orthodox Mission Fund of Houston, St Stephen The Great or SSG LLC? Is it one of Mark Brewer’s projects for the mission and work of the Orthodox community? or is the 40 Holy Martyrs Church a client of Brewer & Pritchard, PC. directly and therefore the registrants address is the legal law offices of bplaw.com? One assumes they know they have been linked to another charity and if so one wonders what are their thoughts at a time when the said charity they are linked to through this domain registration is going through Bankruptcy proceedings and all the other tribunals and issues that are linked with them in the UK. Intersting isn’t it – Perhaps someone from the church or one of the other parties would like to clarify things and give an official statement.

I will of course post anything that is sent to me onto this blog.

Just in case you aren’t US orientated: The First Amendment of the Bill of Rights as stated in the US Constitution:

“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.”

One supposes a law firm such as Brewer & Pritchard, and a republican lawyer based in Houston like J. Mark Brewer has a solid understanding of these things?

Click the pink elephant to see where it leads – actually it leads to a brilliant case study utilising J. Mark Brewers Cease and Desist letter as sent from the Brewer and Pritchard Law Firm.

Another excellent site in relation to Cease and Desist letters, the internet and US First Amendment rights is this one: chillingeffects.org/ , it would certainly be one of the first places I would be hiving off to with any C&D I received!

‘Free Speech excercised both individually and through a free press, is a necessity in any country where people are themselves free’ – Theodore Roosevelt. 1918.

I want a button badge, or a cool blogger button like the Dave Walker ones for this one too!! but alas such is not my skill so I will pine on for longer – actaully though I can edit pictures!

I am Ma-- BlogSwatter

(image modified & snitched from original at scottthong.wordpress.com )

yes, yes, what’s that they say – imitation is the sincerest form of flattery and sarcasm is the lowest form of wit! So I guess then that’s two birds with one stone!

Mr Brewer it would seem is sending out yet more emails, though it would appear these are not confidential! these ones would seem to be in response to the I am Dave Walker resistance movement. http://revjph.blogspot.com/2008/08/spckdave-walker-update.html & http://gafcon.blogspot.com/2008/08/poor-mark-brewer-hes-not-dave-walker.html
Ohh all of this is so allowing me to use all those aphorisms I know! Here’s another one (actaully it is my maternal parental units favourite one): two wrongs don’t make a right! (well that and ‘just because they did would you stick your head in a gas oven’ – which now I come to think of it is suitably appropriate as well!)

Obviously this is kind of amusing, in a sort of sick and twisted way that is. For the usual details and keep up can I refer you back as ever to Matt Wardman, SPCKSSG and all the usual ones as per my links just to the side!

You know how in the cartoons all the cute but furious rotund bees or wasps have round bottoms and pointy stingy tales and do the wiggle dance?
Well that’s the image I have in my head, lots of comic buzz buzz blogger bee’s all doing the wiggle dance and aiming their stingers ready to fire at those who would try to steal from or attack them – now in the cartoons its usually the honey someone is trying to steal, or its flowers they are trying to pick which the bees are sitting on, or if its wasps its usually the wasps nest someone is trying to remove! see where I am going with this one and why it seems to fit so well??
Yep well the honey equates to the word (your word is like honey to my lips!) and in this instance the words equate to the freedom of speech and the right to comment!
The flowers, well that’s our individual blogs and websites that some people try to pick on or pick off – use whichever one fits for you, though both might be apt!
The wasp nest, well that’s the blogosphere of course – the hive community in which we all reside, humming along and working away, and yes again someone is trying to knock it down and dismantle it – well bits of it.
Of course we are the bee’s and the wasps, normally quite content just to get on with our blogging, but yes we have stings in our tails and when we are riled up we fire, we show our hive mentality and work together as the collective to protect the habitat and each other.
And today – well today the wiggle dance (the loosely termed Walker Wiggle Dance in honour of the blogger bee first SLAPPed) moved on a step and the first stinger was fired straight and true (yes we had all been doing our collective thing and following the leaders advice – thanks Matt!) but today the wiggle dance turned into a haka with Elizaphanian leading the dance.
